General Terms and Conditions of Bate GmbH, Loowiesenstrasse 29, CH-8106 Adlikon
1. Scope
The following terms and conditions apply to all orders placed over the Internet by the customer at Bate GmbH and are recognized with each order.
2. Conclusion of contract
The information on our goods and prices within the ordering process are non-binding. The customer makes a binding offer with his order, this is accepted by us as soon as we assign an order number to the offer. Until then, we have the right in particular to refrain from the delivery of the goods offered in the event of unavailability. Only with the acceptance of the offer, a claim arises on the delivery of the goods.
2.1. Payment in advance
We deliver goods only against payment in advance / bank transfer, Postfinance, VISA and MasterCard to all customers.
2.2. Withdrawal
The customer can cancel his order within two weeks without giving reasons in writing (eg letter, fax, e-mail) or by returning the goods.
The period begins at the earliest with receipt of this instruction. To maintain the cancellation period, the timely dispatch of the revocation or the thing is sufficient. The revocation must be sent to:

In the case of an effective cancellation, the mutually received benefits must be returned. If the customer is unable to return the service in whole or in part or only in a deteriorated condition, he must pay compensation for the value. Incidentally, the customer can avoid the obligation to pay compensation by not using the item as his own property and refraining from anything that affects its value. The costs of the return are to be paid by the customer for parcel shipping items up to a value of 40 Chf or at a value over 40 Chf if at the time of revocation not the consideration or a contractually agreed installment has been provided, otherwise the return is at cost and risk of poolshop-online.de. Non-parcels are picked up at the customer. Obligations to reimburse payments must be fulfilled by the customer within 30 days after sending his revocation.
3. Prices
The prices listed on the internet at the time of ordering apply. The quoted prices are final prices and include the respectively valid VAT, plus any applicable shipping costs.
Changes in the form, color and / or weight of the goods remain within reason.
4. Delivery
4.1 within Switzerland
The delivery takes place from our distribution warehouse to the delivery address specified by you. The shipping costs correspond to the respective information.
For partial deliveries we are entitled and of course bear the resulting additional shipping costs.
If the delivery fails via forwarding and has to be delivered a second time, it will be charged to the customer and will be charged by invoice.
4.2 Deliveries to other European countries
Deliveries to other European countries are made according to the current tariffs for shipping to other European countries at the expense of the customer less the costs incurred for shipping within Switzerland. The customer is informed about the shipping costs before delivery of the goods.
5. Right of return
With justified reasons, the customer can return the received goods within two weeks. The period begins at the earliest with the receipt of the goods. The costs of the return must be borne by the customer. The goods credit will only be given if the returned goods have been booked in our warehouse as an account.
Altered, improperly opened or specially made goods are excluded from the return.
6. Payment abroad
For orders from other European countries, payment in advance after receipt of the invoice, which includes the individual shipping costs of each country.

The delivered goods remain the property of Bate GmbH until full payment
8. Warranty
Authorized warranty claims of the customer are limited to a right to repair or replacement. The customer is entitled to reduce the remuneration or withdraw from the contract if the replacement or repair fails.
Obvious defects in the delivered goods must be reported in writing no later than one week from receipt of the goods. In the case of improper use and / or incorrect operation, the customer bears the costs of the repair or rework.
9. Limitation of Liability
The product images do not always have to match the appearance of the delivered goods. In particular, changes in the appearance of the goods may occur after the manufacturers have renewed the range. There are no errors in the product description
